- GENERAL - CSLM Inc. is the corporation that operates The Crest Theatre, hereafter referred to as "the Crest". CSLM Inc. provides The Crest Theatre and its services to "the applicant" on a rental basis only. The applicant is the party signing the contract and responsible for all business dealings including payment. CSLM Inc. does not allow its name or that of the Crest to be used without its written permission except as it applies to that specific rental. CSLM Inc. reserves the right to refuse rental of the Crest for any use which CSLM Inc., and solely CSLM Inc., deems undesirable or incompatible with its long term goals. CSLM Inc. must approve the use of the Crest name in all advertising. CSLM Inc. reserves the right to require references and to research past events in which the applicant, act and/or subcontractors have been involved.
- AUDITORIUM - The use of the auditorium includes the use of the lobby, house lights and curtain warmers, stage and upper green room/dressing room. An operator will be provided by The Crest for basic set up and on/off house light operation. Note that these lights are not theatrical stage lights, which are available at an additional charge. The Crest Theatre complex consists of 3 separate auditoriums. Each auditorium rents separately per the contract terms.
- THEATRICAL STAGE LIGHTING AND CONCERT SOUND SYSTEM - The Crest Theatre has an in-house theatrical lighting system and concert sound system available that is managed by Substrate Engineering (530) 756 7312, an outside contractor. There is an additional charge for this equipment, and is subject to availability.
- FILM PROJECTION - The Crest Theatre is equipped to show 35mm, with optical mono, stereo or digital surround sound, per formats indicated in technical specifications. There is an additional charge for the projectionist and equipment. (Union operator only) The Crest reserves the right to run a maximum of two trailers per showing.
- TICKET SALES - The Crest Theatre maintains an exclusive contract with Tickets.com with respect to all electronic ticket sales for events held at the Crest. Once your show has been confirmed and your deposit has been received, your show will be built on the Tickets.com system for advance sales through all Tickets.com locations, including the Crest Theatre Box Office and the Tickets.com internet/phone sales system. The Crest Theatre will staff the box office on the night of your event for walk-up ticket sales and will-call sales ticket pick-up. The Crest will provide a settlement report on the night of the event with a breakdown of all tickets sold. Ticket monies collected by Tickets.com and The Crest will be settled with you 10 days after the event date. A box office fee of $100.00 versus 4% of all tickets (whichever is greater) sold through the tickets.com system and the Crest Theatre Box Office will be automatically charged to your rental contract. Applicant will be responsible for any and all customer credit card charge-backs for ticket purchases made through tickets.com or the Crest Theatre Box Office. Subject to the approval of the Crest, you may have hard tickets printed by the Crest (the quantity of hard tickets generated will automatically be deducted from the quantity available from sale over the system) for sale at up to two alternate ticketing locations, provided that no electronic or hard ticketing system is used. The charge for hard ticket printing is $0.15 per ticket, and the sales of these tickets are not subject to the 4% box office charge noted above. For small community and/or non-profit events, subject to the written approval of the Crest, you may request an exemption from this ticketing requirement.
- CAPACITY - The capacity of the auditorium is 975, including all complimentary and give-away admissions. There are 911 fixed seats and 64 portable seats (if needed). If the production requires that any seating areas be used for sound, lighting or other equipment, a maximum capacity of 950 seats will be authorized, including all complimentary and "give away" tickets. Large numbers of performers may reduce your authorized capacity. Do not oversell or overcomp your show. Authorized capacity is stated on the front of the contract, specific to your event. The Crest retains 100% of all admission revenue in excess of contracted capacity. All Reserved seating events are required to use Tickets.com ticketing system exclusively.
- TICKET REFUNDS - The Crest reserves the right to determine when ticket refunds (including any service charges) may be made. Sufficient cause shall include, but not be limited to: lack of seats, seats blocked by equipment when exchange for comparable location is not possible, act substitution, show not as advertised, failure of equipment, failure to open doors or start show within a reasonable period of time as scheduled.
- THEATRE CONCESSIONS - The Crest reserves the exclusive right to operate the snack and beer/wine concessions areas. CSLM, Inc. provides all staff to operate and retains 100% of the revenues derived from the operation. If the applicant desires the snack or bar concessions to remain closed, a charge may be made.
- MERCHANDISING CONCESSIONS - The Crest will allow the artist's merchandising representatives to sell t shirts, records, tapes, CD's and souvenirs. The Crest will provide a table, chairs and power. The Crest retains 20% of the gross sales as a hall percentage. This information must be forwarded to the artist's merchandising representative. The applicant is responsible for this percentage if the merchandising representative underpays or refuses to pay. No give-away stickers are allowed.
- BOX OFFICE & DOORMAN - The Crest does not provide a box office person, doorman or change. These services are available for an additional charge.
- USHERS - For general admission, the Crest requires 1 usher per 250 patrons, 2 minimum. 2 ushers are included, extra ushers are available for an additional charge, or may be provided by the applicant. Reserved seating requires additional ushers. The Crest's ushers are not security staff. The applicant is responsible for security personnel at all doors to prevent unauthorized entry to the theatre.
- SECURITY PERSONNEL - Applicant is responsible for providing adequate, easily identified security personnel suitable for the type of event being promoted. Applicant must also insure security outside the building, including the front doors and back stage. The Crest reserves the right to cancel the show if the security is inadequate for the event. Generally, minimum security requirements include 4 personnel arriving 30 minutes before your event’s scheduled door time, and staying on premises 15 minutes after the last patrons exit. Additionally, a minimum 1 security person is required for each 100 patrons in attendance for all contemporary music shows such as rock, metal, reggae, punk and R&B. The Crest Theatre reserves the right to require additional security, at the sole cost of the applicant, as it deems necessary. Uniformed security must be licensed to operate within the City of Sacramento. No armed security personnel are allowed unless currently licensed as a police or correctional officer (off duty police).
- FOLLOWSPOT OPERATOR - The Crest has a contract with I.A.T.S.E Local 50 that includes the provision that all projection equipment and followspots will be operated by union operators. The minimum shift (included in the follow-spot rental cost) is 3-1/2 hours. Additional hours will be charged at the current rate.
- DRESSING ROOMS - The Crest has a stage level green room with bathroom (included with the facility rental) and an under stage level with 2 dressing rooms and a production office (additional fee and security deposit required). These are not party areas and the Crest reserves the right to enter any and all areas to enforce the rules and to limit the number of people in the area. No kegs or smoking are allowed in the dressing or green room areas. The applicant is responsible for clean-up by placing all trash in bags provided.
- DAMAGE TO FACILITY - The applicant is responsible for all damage to the facility caused by, or as a direct result of their event, by guests, patrons, staff, crew, and subcontractors. This specifically includes damage to curtains, projection screen, projection masking, bathrooms, dressing rooms, seats, stage, sound equipment, lighting equipment and furnishings. Applicant is also responsible for lost revenues due to damage.
- SECURITY DEPOSIT - A security deposit may be required of all applicants using the facilities. This deposit must be paid by cash or certified check before load-in may begin, and will be refunded by check, less any amount due to us, the following business day.
- ELECTRICAL POWER - Power is available for brought in equipment as listed in the house specifications. Applicant or lighting subcontractor must provide adequate length and gauge of feeder cable. There is an additional charge for the use of this power, which includes the electrician's labor for tie in and disconnect of this service. All connections shall be made by Crest Theatre electricians who reserve the right to refuse connection of dangerous, defective or non code conforming equipment. All connections are to NEMA Lugs located within 50 feet off stage left. Distribution panels and feeder cable are available for an additional charge.
- NON PROFIT ORGANIZATION DISCOUNT - Any group registered with the State of California as a 501C-3 "not for profit" corporation is eligible, at the sole option of the Crest, to receive a 10% discount from the first 4 hours of your base house rental charge. A copy of your non profit letter, signed by the Secretary of State or your IRS non-profit registration must accompany the returned contract and your deposit check. The not for profit corporation must be the rental applicant for the event.
- CLEAN UP - The applicant is responsible for clean up beyond that normally expected for an event of this type. This generally would not include the audience area. Applicant is responsible for clean up of the stage area and dressing rooms, including decorations, stage garbage, tape, drinks and food.
- DECORATIONS - The following decorations are specifically prohibited from the theatre building: confetti (static and cannons), glitter, stickers, spray paint, liquid paint, burning objects (including candles) and helium balloons. The applicant is responsible for picking up all decorations. The applicant must submit a decorating plan and obtain approval of all decorations from the theatre manager in advance of the event. No tape, staples, holes or nails in the walls will be permitted.
- CATERING & ALCOHOL - This section applies to catering and alcohol to event patrons. This does not apply to catering for production staff and crew. Catering (without charge for food) is allowed at an event provided the catering personnel clean up after the event. A catering fee will be charged by the Crest. The Crest can not provide ice for catering. Power for catering is limited to 2 20 amp circuits in the location of the snack bar. ALL ALCOHOLIC BEVERAGES MUST BE SERVED BY THE CREST THEATRE. ALL ALCOHOL MUST REMAIN IN THE LOWER LOBBY. THESE ARE "ALCOHOL BEVERAGE CONTROL" LICENSE REGULATIONS AND WE DO ENFORCE THEM. All alcohol for entertainers must remain in the dressing rooms or in the "back stage" area. The applicant is responsible for preventing under-age or "out of control" drinking.
- SEATING - The Crest Theatre has three seating options.
- General Admission: "first come first served", no seats reserved.
- Reserved Section: different tickets (usually at different prices) are sold for different sections, most commonly upper and lower, also called orchestra and balcony. Lower section may be reserved seating, the upper section will be general admission. Extra ushers are required for reserved section seating events.
- Reserved Seating: A ticket is issued with a seat number corresponding to a specific seat in the auditorium. Different ticket prices may be charged for different sections. Extra ushers are required for reserved seating events.
- DISABLED SEATING - Disabled seating areas must be priced at the lowest ticket price. Wheelchairs take up the space of two seats but are only required to purchase one ticket. 1 companion ticket may also be purchased for this section. 4 wheelchair tickets must be held until 30 minutes before showtime, unless sold out.
- HEAT OR AIR CONDITIONING - The rental rate includes heat or air conditioning which begins 1 hour before doors open to the public and ends at the conclusion of the event. Extra hours are available at an additional charge.
- PARKING - There is no parking available for cars directly behind the Crest. Those parking areas are owned by other businesses and are not for theatre use at any time. DO NOT PARK BEHIND THE THEATRE! It is the applicant's responsibility to inform their employees, subcontractors and guests of this policy. The Crest assumes no liability for any vehicle. Truck parking is by city permit only, as directed by Crest representative. Arrange for an alley permit by calling the Crest. There are parking garages located at 10th & L streets and at 11th & J streets, both are less than 1/2 block from the theatre. Please direct your people to use them. The Crest depends on the good nature of the businesses behind the theatre to allow equipment loading and temporary inconveniences to their customers. (PARKING IN THEIR LOTS MAY RESULT IN THE CANCELLATION OF THE SHOW WITHOUT REFUND TO THE APPLICANT.) Do not contact these businesses or try to arrange parking in these lots. All communications concerning parking must go through the Crest. It is the applicant's responsibility to enforce these parking rules.
- FIRE SAFETY - The Crest Theatre enforces fire protection safety codes and is subject to inspection by the State Fire Marshall and the City of Sacramento Fire Department. No pyro devices or open flame, including candles, are allowed in the theatre. All fire aisles and exits must be kept clear of equipment and people. Crest Theatre technical staff will clarify exiting clearances, but the ultimate authority is the City of Sacramento Fire Department and the office of the State Fire Marshall, who may modify these requirements without recourse. No smoking is allowed anywhere in the building, including dressing rooms. There is no standing allowed in the aisles, or on the stairs in the upper section. This must be enforced by the applicant's security staff. FAILURE TO FOLLOW THESE RULES WILL RESULT IN THE IMMEDIATE SUSPENSION OF THE SHOW (OR LOAD-IN) UNTIL THE CONDITIONS ARE CORRECTED. IF THEY ARE NOT CORRECTED, THE SHOW WILL BE CANCELLED WITHOUT REFUND TO THE APPLICANT.
- DISRUPTIVE PEOPLE - The Crest reserves the right to eject, or cause to be ejected from the premises, any person or persons engaging in disruptive, belligerent or threatening conduct. The Crest reserves the right to refuse admission to any person displaying the above behaviors or who appear intoxicated. The Crest shall not be held liable for any damages by the applicant through exercising this right.
- HOLDS, BOOKING, AND PAYMENT POLICY - The Crest accepts holds for event date reservation with the following conditions: Holds are non-binding, on a first call availability basis and held for a promoter for a specific event only. Other promoters have access to that date for the same event only. Challenges for a different event will be accepted, where the promoter who has the existing first hold will be given 48 hours to confirm or give up the hold. The challenger then becomes the first hold, subject to all terms of the booking policy. The challenge fee will then be applied to the rental deposit upon confirmation. Holds are good for 15 days only. Holds over 15 days may be automatically released unless renewed by the applicant. A maximum of 6 dates may be held at a time by any one promoter.
- The deposit (cash or certified check if within 45 days of event) must accompany the return of the signed rental contract. (Governmental agencies may submit purchase orders as required.) The deposit is not refundable.
- The balance due less Tickets.com ticket sales must be paid (in cash or certified check unless other written arrangements have been made) 96 hour before the event. The insurance certificate is also due at this time. (Governmental agencies may submit purchase orders as required.)
- The refundable security deposit is due (cash or certified check only) before loading in to the building. (Not required from governmental agencies with purchase order)
- We will close out the contract the next business day following the event and refund the security deposit less the amount owed at this time. Settlement of ticketing money is per item #6 "TICKET SALES".
- Bounced deposit checks will result in the immediate release of your date and a charge of $50.00.
- HOUSE RESERVED SEATS - The Crest reserves the right to a maximum of 4 admissions to each event held at the Crest Theatre. These admissions do not affect your capacity which is stated on your contract. These admissions are for use by the Crest with no restrictions.
- DOOR & SHOW TIMES - Doors shall open one hour before contracted show time unless agreed to in writing in the rental contract. The penalty for failure to open the doors or start the show on time for any reason shall be $200/hour, chargeable in 15 minute / $50.00 increments. Please be sure to schedule your event set-up with this in mind.
- INTERMISSIONS – The Crest may require that your show take an intermission. Revenue from our concessions sales are used to help offset the cost of operating the facility, and directly affects the rental rates charged to the end user. A charge will be made for failure to take an intermission if required by your facility rental contract.
- CITY POSTER LAW - Sacramento City Code 3.08.152 et seq. provides for fines to be imposed on those persons posting advertisements on public or utility property (ie. utility poles). These fines would pay for the removal of such signs. The Crest does not authorize, cause, permit, encourage, direct, recommend or approve the posting of signs on public or utility property. The Crest does not authorize the use of the Crest Theatre name on any materials used in this manner.
- CANCELLATION - The Crest retains the right to cancel this contract with written notice at any time for the following reasons: misrepresentation of the event, lack of insurance, bounced deposit check, threats of violence or actual violence to any Crest employee or subcontractor by applicant's employees or subcontractors, threats of damage or actual damage to the Crest Theatre by applicant's employees or subcontractors, damage or theft of Crest property by applicant's employees or subcontractors, or failure to abide by the terms and conditions of this rental contract. Cancellation by the Crest for any of the above mentioned reasons will result in the loss of the entire rental amount. The applicant may cancel the event at any time up to 96 hours before load in time with loss of deposit only. Cancellation of the event with less than 96 hours notice will cause applicant to be liable for the entire rental fee unless otherwise arranged and agreed to in writing. Cancellation of the event, for any reason, entitles the ticket purchaser to a full refund, including service charges, payable at the place of ticket purchase within 48 hours of the date of cancellation.
- HOLD HARMLESS - Applicant shall indemnify and hold harmless CSLM Inc., Wells Fargo Bank, Briggs Trust and Substrate Engineering against any and all liabilities, suits, damages, actions and/or claims (including attorney’s costs) arising out of the applicant's use of the theatre. This includes, but is not limited to damage to property or injury to any patron, event attendee, applicant, applicant’s employee, applicant’s volunteer, applicant’s subcontractor, and/or applicant’s agents. This also includes any contractual obligations, including but not limited to artist fees, film rental fees (unless agreed to by CSLM in writing), equipment rental, copyright holders and/or advertising firms.
- LIABILITY - CSLM Inc., The Briggs Trust, Wells Fargo Bank and Substrate Engineering are not liable for any damages, including consequential damages, for their failure to perform as stipulated in this contract, including but not limited to equipment failure, due to circumstances beyond the control of the above organizations. In any event, any monies returned to the applicant shall be limited to the contracted rental amount.
- INSURANCE - The applicant is required to maintain a $1,000,000 liability insurance policy. The applicant must secure the policy as the Crest does not provide insurance. The following 4 organizations must be named additionally insured with respect to the facility.:
- CSLM, Inc. (theatre operator) 1013 K Street, Sacramento, CA 95814
- Wells Fargo Bank (property manager) 1013 K Street, Sacramento, CA 95814
- The Briggs Trust (property owner) 1013 K Street, Sacramento, CA 95814
- Substrate Engineering (facility services) 1013 K Street, Sacramento, CA 95814
Proof that the policy is in effect must be furnished to the Crest in the form of a "Certificate of Additionally Insured" a minimum of 96 hours (4 days) before load-in to allow time for corrections if needed. CSLM reserves the right to demand a copy of the actual policy. State and Federal agencies must submit a letter stating that the above parties are held harmless with respect to the contracted event.

- REFERENCES - CSLM Inc. reserves the right to request and process business references, act references and venue production references where you have produced similar events, depending on the type of event being contracted for.
- MODIFICATION - This "RENTAL HANDBOOK", "CONTRACT DOCUMENT" and "FEE SCHEDULE" represent the entire agreement between the parties and any term not expressed herein is not intended to be part of this agreement. This contract may be modified in writing only, signed by an authorized CSLM Inc. representative and the applicant. The terms of the contract are subject to any special arrangements as listed under "special terms" on the contract document.
- AUDITORIUMS #2 and #3 - These auditoriums are available for daytime rental events, available weekdays (Monday thru Thursday) with a required out time of 5pm. Exceptions may be made on a case by case basis, in writing as part of the contract document. These theatres are also available Monday thru Thursday after 5pm, subject to availability. Weekly rental are also possible, subject to auditorium availability. All rentals include basic stage lighting wash (no technician, cues or focus), no reinforcement sound system, and one theatre manager for the complex. Film projection staff and production technicians are available for an additional charge. 3 - 120 volt/20 amp convenience circuits are included at no additional charge at each stage for sound and video equipment.
